When a driver or passenger is injured during a ride share or hit by a vehicle making a delivery, the rights of the injured person in Kentucky remain the same. These accidents can be complex, however, because the entire insurance picture changes.
Kentucky auto insurance legal requirements apply to any accident in the Commonwealth. This means that an injured party should still have access to Kentucky No-Fault benefits, covering medical expenses, wage loss, prescriptions, and out-of-pocket expenses. The required no-fault limits of $10,000 per injured party still apply. Kentucky also requires each driver to maintain bodily injury coverage of at least $25,000 per person and $50,000 per accident. This means an injured party who is not to blame for the accident will still have the right to recover from injuries and will still be protected in a ride share accident. The Kentucky minimum coverage of at least $10,000 for vehicle damage also applies.
The complexity in these situations arises, however, from the ride share situation. Most insurance policies in Kentucky will exclude coverage for a situation where the driver of the vehicle is using the vehicle for commercial purposes, or ‘for hire,” such as when the driver of the vehicle that causes the accident is taking passengers for pay or delivering carry out meals. This means that the at-fault driver’s registered insurance will most likely not apply.
The claims of the injured party, however, are not extinguished simply because the policy that the at-fault driver carries is not valid at that moment. Due to Kentucky’s insurance requirements, the entity that the ride share or delivery driver is working for at the moment of the accident will ordinarily provide insurance for the accident.
